Congress Acts on Disaster Relief Measures


The U.S. House Committee on Transportation and Infrastructure on October 20, is expected to introduce language updating the threshold for “small project” designations under the Stafford Act. The threshold for small projects is adjusted annually for inflation. The Fiscal Year 2020 threshold is $131,100. For small projects, final funding is based on the estimate at the time of project approval, and certification of project completion is required when the project has been finished.

The proposed measure includes language that would raise the cost estimate of projects to qualify from $35,000 to $1 million. Additionally, the intent of this legislation is to expedite the recovery process for smaller projects, particularly in rural areas or communities.

On Tuesday, October 19, the U.S. Senate, by unanimous consent, passed S. 3011 to amend title VI of the Social Security Act allowing states and local governments to use coronavirus relief funds for infrastructure projects. If they were approved under the American Rescue Plan Act, Public Act 117-2.
