U.S. DOT Proposes Update and Seeks Comments on National Environmental Policy Act


The U.S. Department of Transportation (DOT) recently issued a proposal to update its implementing procedures for the National Environmental Policy Act (NEPA). DOT is specifically seeking public review and comment for considering environmental impacts. The Department last updated its current NEPA procedures (DOT Order 5610.1C) for considering environmental impacts in 1985. The proposed order seeks the following:
  • Ensure the NEPA process includes meaningful public involvement throughout, and balanced consideration of a range of alternatives;
  • Improve efficiency and expedite project delivery;
  • Provide good customer service to stakeholders through consistent implementation of NEPA across the department;
  • Provide flexibility for the department’s Operating Administrations (OAs);
  • And, apply NEPA implementation procedures to specific programs, and balance the needs of all OAs from those with established NEPA programs to those seeking more guidance.
